1. Acceptance of Terms
By accessing or using lenderready.ca (the "Site") or any LenderReady product or service (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.
LenderReady is operated as a sole proprietorship based in Canada, with a mailing address at 1065 Canadian Pl, Suite 201-340, Mississauga, ON L4W 0C2 ("LenderReady," "we," "us," or "our").
2. What LenderReady Is
LenderReady is an educational platform and software service that provides:
- Free and paid tools to help Canadian entrepreneurs prepare business plans and loan applications
- Educational content about commercial lending in Canada
- A Loan Review service in which an experienced commercial banker reviews a customer's declined or pre-submission loan application and provides written feedback
3. What LenderReady Is Not
LenderReady is not, and does not provide:
- A bank, credit union, lender, or financial institution
- A licensed financial advisor, mortgage broker, investment advisor, or securities dealer
- A law firm or provider of legal advice
- An accounting firm or provider of tax advice
- An agent, representative, partner, or affiliate of any bank, lender, government agency, or financial institution
We do not lend money, broker loans, accept loan applications on behalf of any lender, or have any role in any lender's credit decision.
4. No Guarantee of Loan Approval
You understand and agree that:
- Lending decisions are made solely by lenders, based on criteria that may include information not visible to or considered by LenderReady
- LenderReady does not guarantee that any business plan, loan application, or Loan Review will result in loan approval, improved loan terms, or any specific financial outcome
- Past results, sample plans, and testimonials are illustrative only and do not predict future outcomes
- You are solely responsible for the accuracy of information you provide to lenders and for your own borrowing decisions
5. Educational Purpose Only
All content, tools, scores, reports, business plans, financial projections, and reviews provided through the Services are for educational and informational purposes only. They are not financial, legal, tax, or investment advice. You should consult qualified professionals before making borrowing, investment, or business decisions.
6. Loan Review — Specific Terms
A Loan Review is a paid service in which a commercial banker reviews a customer's loan application or business plan and provides written observations and suggestions.
You acknowledge and agree that:
- The Review is an educational analysis based on the information you provide
- The Review is not a guarantee, prediction, or promise of any lending outcome
- The reviewer is providing observations based on commercial banking experience, not legal, tax, or licensed financial advice
- LenderReady does not contact, communicate with, or have any relationship with your lender
- You remain solely responsible for any decision to apply, reapply, or modify your loan application
- LenderReady's obligation under this service is limited to providing the written Review described on the product page
7. Pricing, Payment, and Refunds
Prices for paid Services are listed on the Site and are in Canadian dollars unless otherwise stated. All payments are processed through Stripe, our third-party payment processor. Refund eligibility is described in our Refund Policy.
8. Intellectual Property
All content on the Site, including text, graphics, logos, software, and the structure and selection of content, is owned by LenderReady or its licensors and is protected by Canadian and international copyright and trademark laws.
When you generate a business plan or report using our Services, you own the resulting document and may use it for any lawful purpose, including submission to lenders. LenderReady retains ownership of the underlying tools, templates, and software.
9. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Services
- Submit false, misleading, or fraudulent information to LenderReady
- Use the Services to prepare materials for fraudulent loan applications
- Resell, redistribute, or commercially exploit the Services without our written permission
- Reverse engineer, scrape, or copy the Services beyond personal use
10. Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided "as is" and "as available," without warranties of any kind, express or implied
- LenderReady disclaims all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement
- LenderReady is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business opportunities, or damages arising from any lending decision
- LenderReady's total aggregate liability for any claim arising out of or related to the Services shall not exceed the greater of (a) the amount you paid LenderReady in the 12 months preceding the claim, or (b) one hundred Canadian dollars (CAD $100)
11. Indemnification
You agree to indemnify and hold harmless LenderReady, its owner, and its affiliates from any claim, demand, loss, or damages arising out of (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
12. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Services after changes constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.
15. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
